Donald Trump Secures Another Big Win

Former President Donald Trump began his week with another resounding victory after one of the federal criminal cases against him was dismissed. 

Federal Judge Aileen Cannon dismissed the classified documents case against the former president, citing the unconstitutionality of Special Counsel Jack Smith’s appointment. According to Judge Cannon, Jack Smith’s appointment violates the Constitution’s Appointments Clause and Appropriations Clause.

Judge Cannon found that Jack Smith’s appointment breached the role of Congress in the appointment of constitutional officers. The Trump-appointed judge also found that the special counsel’s appointments breached the role of Congress in authorizing expenditures by law.

In an opinion, Cannon explained that relaxing either of those two clauses would have severe consequences for the case and other future cases.

The judge drew from the recent Supreme Court ruling on the former president’s immunity. Supreme Court Justice Clarence Thomas wrote for the majority that Smith’s case agonist Trump can not go forward if there are no laws guiding his appointment.

“If there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President,” Thomas wrote in the majority opinion.

The case dismissal comes less than 24 hours after Trump escaped an assassination attempt

Trump, who will officially become the GOP nominee this week, told Fox News he was thrilled about the case dismissal. 

“I am thrilled that a judge had the courage and wisdom to do this,’ Trump said “This has big, big implications – not just for this case but for other cases… it only makes this convention more positive.”

The ruling will have a major impact on Jack Smith’s second federal case against the former president. The special counsel secured another indictment against Trump in relation to the January 6 Capitol Protest. 

At the beginning of the year, Trump faced four indictments. However, only the hush money case brought by Manthan District Attorney Alvin Bragg has gone to trial. Smith brought two of those indictments against Trump. However, the Supreme Court’s decision on presidential immunity and Cannon’s latest ruling means both cases are as good as dead. 

Fulton County District Attorney Fani Willis brought the fourth case against the former president. Willis’ case suffered major setbacks after Trump and his co-defendants in that case sued to have Willis removed the case. The defendants revealed that Willis was having an affair with Nathan Wade, one of her prosecutors. They argued that Willis benefited financially from prosecuting the case because Wade was using the money he made on the case to take her on lavish vacations.
