Forner President Donald Trump is facing another legal headache after a grand jury returned a superseding indictment against the former president on Tuesday. 

Special Counsel Jack Smith secured the new indictments in connection to the former president’s 2020 election interference case. Smith was forced to file new charges against Trump following the Supreme Court ruling that found presidents have immunity from prosecution for official acts taken in office.

The Supreme Court ruling means Smith’s earlier indictments in the January 6 case would not have survived a court hearing. The special counsel filed the same four charges in the previous indictment but omitted allegations relating to the former president’s “attempt to leverage the Justice Department.” 

The new indictment also stated clearly that Trump’s actions on January 6 were outside his official duties as president, therefore making them subject to prosecution.  The new indictment also stated that Trump had no official duties regarding the “convening of legitimate electors or their signing and mailing of their certificates of vote.”

“The superseding indictment, which was presented to a new grand jury that had not previously heard evidence in this case, reflects the Government’s efforts to respect and implement the Supreme Court’s holdings and remand instructions in Trump v. United States,” Smith wrote in a notice.

Trump responded to Smith’s latest move on his Truth Social account, describing it as an effort to interfere with the November election. 

“In an effort to resurrect a ‘dead’ Witch Hunt in Washington, D.C., in an act of desperation, and in order to save face, the illegally appointed ‘Special Counsel’ Deranged Jack Smith, has brought a ridiculous new Indictment against me, which has all the problems of the old indictment, and should be dismissed IMMEDIATELY,” Trump wrote.

The former president noted that  Smith violated the Justice Department’s long-standing practice of not bringing cases before the election. 

“I’ve also been informed by my attorneys, that you’re not even allowed to bring cases literally right before an Election – A direct assault on Democracy!” he wrote. “This travesty is now on Comrade Kamala Harris, who is actively pushing it, rather than immediately calling for its dismissal, as should be done. This is for Third World Countries and Banana Republics, not for the U.S.A.!”
